Terms & Conditions

The agreement between you and ClearClaim IP Enforcement for our services, plans and one-off orders.

Last updated: 7 October 2026

1. About these terms

These terms are the agreement between ClearClaim IP Enforcement ("ClearClaim", "we", "us") and you, the business or person using our services ("you"). Your order form or quote, if you have one, forms part of this agreement. If the two disagree, the order form wins.

By creating an account, ticking "I agree", buying credits or placing an order, you accept these terms. If you're accepting for a company, you confirm you're allowed to bind it.

We may update these terms. We'll change the date at the top and, for changes that matter, tell you by email or in your dashboard at least 14 days before they apply. If you keep using the services after that, the new terms apply.

2. What some words mean

  • "Services": monitoring, detection, evidence capture, takedown notices, counter notices, strike removal, reports, the ClearClaim dashboard and anything else in your order.
  • "Platform": the ClearClaim website, dashboards, tools and systems you use to receive the services.
  • "Your content": the material, documents, trade marks, copyright works and information you give us.
  • "Infringing content": material online that you tell us, or we find, appears to infringe your rights, including copies of your work, fake goods, misuse of your name or logo, cheats and exploits for your game, and impersonation.
  • "Takedown": a notice to a platform, host, registrar, search engine, marketplace or payment provider asking it to remove or disable infringing content, under the DMCA (17 U.S.C. §512), the EU Digital Services Act, UK law or the platform's own rules.
  • "Credits": prepaid balance in your account, shown in US dollars, used to pay for one-off orders.

3. How long this lasts

Monthly and annual plans start on the date in your order form and run for the term stated there (12 months if none is stated). They renew for the same period unless either of us gives at least 30 days' written notice before the end of the term.

One-off orders last until the order is finished, refunded or cancelled.

4. You appoint us as your agent (power of attorney)

4.1 You appoint ClearClaim as your authorised agent, with a limited power of attorney, to act for you in protecting your intellectual property. This lets us:

  • prepare, sign and send takedown notices, intellectual property complaints and counter notices in your name to platforms, hosts, registrars, search engines, marketplaces, app stores and payment providers;
  • talk to those parties about the status and outcome of your notices, and send follow-ups and clarifications;
  • take other reasonable, lawful steps to get infringing content, fake goods or unauthorised listings removed or disabled.

4.2 This authority is limited. It covers only the services in this agreement and your orders. It doesn't let us start court proceedings, settle claims, grant licences, make admissions or give up any of your rights unless you agree in writing.

4.3 It lasts while this agreement or any order is active. You can withdraw it at any time by writing to us; we can end it by writing to you. If you've also signed a separate letter of authorisation or power of attorney with us, that document applies as well.

4.4 We can refuse, delay or stop any action we think could break the law, a platform's rules or our risk policy. We're not your trustee, escrow agent or legal representative.

4.5 We can use vetted staff, contractors and partner attorneys to carry out the work. We stay responsible for their work under this agreement.

5. Our services

5.1 We'll provide the services in your order or plan with reasonable skill and care.

5.2 What we can't promise:

  • that any particular content will be removed, or that we'll find every infringement;
  • how a platform or host will respond, or how quickly. That's up to them;
  • that the person we report won't file a counter notice or dispute. We don't have to defend you in any claim, dispute or lawsuit that follows;
  • legal advice. ClearClaim is not a law firm. Where a case needs a lawyer, we'll tell you, and our partner attorneys can be engaged separately.

5.3 The services don't include registering your rights, going to court, arbitration, or negotiating with infringers, unless your order says so.

5.4 Nothing is filed without a person checking it. Our software and AI help find and prepare cases; a member of our team reviews every notice before it's sent.

5.5 We give you a non-exclusive, non-transferable right to use the platform during this agreement, only to receive the services. You must not resell it, copy it, reverse engineer it, remove our notices from it, use it to build a competing product, or use it for anything unlawful.

6. One-off orders, credits and payment

6.1 One-off orders (independent takedowns, counter notices, strike removals and similar) are paid from credits. The minimum order is US$75. Counter notices and copyright strike removals are US$125 per video. Other prices are shown when you order.

6.2 The price shown when you order is an estimate based on an automated scan of the link. Our team checks every order. If the work needed is less than estimated, we refund the difference to your credits. If it's more, we ask you before doing the extra work.

6.3 You can top up credits with the cryptocurrencies listed in your dashboard. Send the exact amount shown to the exact address shown, on the network shown, then enter the transaction ID. We check the blockchain for the amount, address and confirmations before adding credits; this can take from a few minutes to a few hours. Payments sent on the wrong network, to the wrong address, or below the amount shown may not be recoverable. Tell us straight away and we'll do what we reasonably can.

6.4 Credits don't expire while your account is open, can't be exchanged for cash except as described in 6.5, and can't be transferred to another account.

6.5 Refunds: if we can't take on an order, or cancel it before work starts, we return the full amount to your credits. Once we've sent a notice, the work for that item is done and isn't refundable just because the platform refuses it. You can ask us to pay unused credits back to you in crypto (at the rate on the day, less network fees) within 12 months of the top-up.

6.6 Plans: fees are as set out in your order form and are due on receipt of invoice unless it says otherwise. Fees don't include taxes; you pay any that apply. If you don't pay on time we may charge interest at 4% a year above the Bank of England base rate (or the statutory rate for late commercial payments, if higher) and pause the services until you pay.

6.7 If you're a consumer (buying for yourself, not a business), you have a 14-day right to cancel a service you bought online. If you ask us to start work within those 14 days, you agree you'll lose that right for work already done, and you'll pay for what we've done up to the point you cancel. Nothing in these terms affects your statutory rights.

7. Your responsibilities

7.1 You tell us what to act on. You're responsible for confirming that you own, or are allowed to enforce, the rights involved, and that the material you ask us to report really infringes them.

7.2 You'll give us, promptly, the documents we reasonably ask for to prove your rights: registration certificates, licences, links to originals, proof of first publication and so on.

7.3 Everything you give us must be true, accurate and complete. You must not ask us to send false, misleading or bad-faith notices, or to target lawful uses such as genuine resale, reviews, commentary, news or parody. Sending a knowingly false notice can make you liable for damages (for example under 17 U.S.C. §512(f)).

7.4 Keep your login details safe, turn on two-step sign-in, and tell us at once if you think someone else has used your account. You're responsible for what happens under your account.

7.5 You must not use the services to break the law, harass anyone, collect personal data unlawfully, get around a platform's security, or suppress competition or criticism. We may suspend the services if we reasonably suspect you have.

8. Intellectual property and data

8.1 Your content stays yours. You give us a non-exclusive, worldwide, royalty-free licence to use, copy and send it only as needed to provide the services, including attaching it to notices and sharing it with platforms.

8.2 The platform, our software, templates, methods, models and know-how belong to us, including improvements made while working for you.

8.3 If you send us feedback or ideas, we can use them freely.

8.4 We may use anonymised, aggregated data (which doesn't identify you or anyone else) to improve detection and publish statistics.

8.5 Information about sellers, sites and accounts we identify as infringing may be kept and used to protect our other clients and improve detection, in line with our Privacy Policy.

8.6 YouTube: parts of the services use YouTube API Services to find public YouTube videos that may infringe your rights. By using the services you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). Google's Privacy Policy (https://policies.google.com/privacy) also applies to that data.

9. Ending the agreement

9.1 Either of us can end this agreement by written notice if the other seriously breaks it and doesn't put it right within 14 days of being asked (or straight away if it can't be put right).

9.2 Either of us can end it straight away if the other becomes insolvent or stops trading, or if carrying on would break the law.

9.3 We can suspend the services straight away if you're overdue on payment, break these terms, or your use creates a legal, security or reputational risk, or if a platform requires it.

9.4 When it ends: the authority in section 4 ends; we stop sending new notices; each of us returns or deletes the other's confidential information (except what the law requires us to keep); you pay for work done up to the end date. Sections that by their nature should continue (including 8, 10, 11, 12 and 13) continue.

10. Confidentiality

Each of us will keep the other's non-public business information confidential, use it only for this agreement, and share it only with staff, contractors and advisers who need it and are bound to keep it confidential. This doesn't apply to information that is already public, that the receiver already had, that it got lawfully from someone else, or that it developed independently. If the law requires disclosure, the discloser will (where allowed) warn the other first and share only what's required. This lasts for five years after the agreement ends, or longer for trade secrets.

11. Promises and limits

11.1 Each of us confirms it has the right to enter this agreement.

11.2 You confirm that you own or are allowed to enforce the rights you ask us to protect, that your instructions are made in good faith, and that the information you give us is true.

11.3 Apart from what these terms say, we don't give any other promises about the services, to the extent the law allows.

12. If something goes wrong (indemnity)

12.1 You'll cover our reasonable losses and costs (including legal fees) from claims by others that arise because: you didn't own or weren't entitled to enforce the rights involved; you gave us false or misleading information or instructions; a notice we sent on your instructions was challenged as wrongful; or you broke these terms or the law.

12.2 We'll cover your reasonable losses and costs from claims that our platform itself (not your content or instructions) infringes someone else's intellectual property.

12.3 The person asking to be covered must tell the other promptly, let them handle the claim, and help reasonably. Neither of us will settle a claim in a way that admits fault for the other without their agreement.

13. Limit on our liability

13.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow to be limited.

13.2 Otherwise, we're not liable for loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss, or for decisions made by platforms, hosts or other third parties.

13.3 Otherwise, our total liability under or in connection with this agreement is limited to the fees you paid us in the 12 months before the event that caused the claim.

14. Law and disputes

These terms are governed by the law of England and Wales. If we disagree, we'll first try to sort it out in good faith by email within 30 days. If that doesn't work, the courts of England and Wales have exclusive jurisdiction, except that either of us can ask any court for urgent relief to protect intellectual property or confidential information, and we can pursue unpaid fees in any court. If you're a consumer living elsewhere in the UK, you can also bring proceedings in your local courts.

15. General

  • Publicity: neither of us will use the other's name or logo in marketing without written permission.
  • Relationship: we're independent businesses. Apart from the agency in section 4, neither of us can bind the other.
  • Notices: we'll contact you at the email address on your account. You can contact us at support@clearclaimip.com.
  • Events outside our control: neither of us is liable for delay caused by events beyond reasonable control. If one lasts more than 60 days, either of us can end the affected order on 10 days' notice.
  • Transfer: neither of us can transfer this agreement without the other's written consent (not to be unreasonably refused), except that we can transfer it as part of a sale or reorganisation of our business.
  • If a court finds part of these terms unenforceable, the rest still applies.
  • Not enforcing a right straight away doesn't mean we've given it up.
  • Only you and we have rights under this agreement (the Contracts (Rights of Third Parties) Act 1999 doesn't apply).
  • This agreement and your order form are the whole agreement between us about the services.

16. Messages from us

If you give us a phone number, we may send texts about your account and cases (for example, a takedown or a dispute). We'll only send marketing texts if you ask for them. Reply STOP to stop texts. Your network's message and data charges may apply.
