Who we are
ClearClaim IP Enforcement ("ClearClaim", "we") is the controller of the personal data described here. You can contact us about privacy at support@clearclaimip.com or 6 Royal Quay, Liverpool, L3 4EX, England, United Kingdom.
This policy explains what we collect, why, how long we keep it, who we share it with and your rights under UK data protection law (the UK GDPR and the Data Protection Act 2018).
What we collect
- Account and contact details: name, email, phone, company name, address, job title.
- Rights and case information: registration certificates, trade mark and copyright details, signed documents (letters of authorisation, powers of attorney), case notes, evidence screenshots and the notices we send.
- Payment information: the cryptocurrency, transaction ID, sending and receiving addresses and amounts for top-ups. We never ask for your wallet keys or card details.
- Requests and disputes: what you tell us in a scan request, quote request or dispute form, and any files you upload.
- Technical data: IP address, browser and device type, sign-in times and security events, to keep accounts safe.
- Information about infringers: names, handles, store and site details, contact details and other information published with infringing content, so we can report it.
Why we use it, and our legal basis
- To provide the services and manage your account (contract).
- To process payments and keep accounting records (contract; legal obligation).
- To send takedown notices and handle disputes and counter notices, which means sharing the necessary details with platforms (contract with our client; legitimate interests in protecting intellectual property; legal claims).
- To keep the platform secure and prevent fraud (legitimate interests).
- To improve our detection and services, using anonymised data where we can (legitimate interests).
- To send service messages, and marketing only if you've agreed or are an existing customer who hasn't opted out (consent; legitimate interests). You can unsubscribe at any time.
YouTube API Services
ClearClaim uses YouTube API Services to search for public YouTube videos that may infringe our clients' rights. Through the YouTube API we read public information about those videos: title, description, tags, thumbnail, channel name, view count and publish date.
We use it only to spot and prioritise possible infringements, show them to the rights holder who instructed us for review, and include them in complaints sent through YouTube's own copyright and trademark processes. We don't sell it, use it for advertising or show it to the public.
We don't ask you to sign in with Google or connect a YouTube account, and we don't access any private YouTube data.
We keep this information while the related case is open and for the periods in "How long we keep it" below, as evidence for the complaint. You can ask us to delete it by emailing support@clearclaimip.com.
By using our services you also agree to the YouTube Terms of Service (https://www.youtube.com/t/terms). Google's Privacy Policy explains how Google handles data: https://policies.google.com/privacy.
International transfers
Some providers, and many platforms we report to, are outside the UK (for example in the US). When we transfer personal data outside the UK we use an adequacy decision, the UK International Data Transfer Agreement or Addendum, or another lawful safeguard.
How long we keep it
- Account and case records: for as long as your account is open, then 6 years (the time limit for most legal claims in England and Wales).
- Payment records: 6 years, for tax and accounting.
- Scan and quote requests from people who don't become clients: 12 months.
- Security logs: 12 months.
Your rights
You can ask to see, correct, delete or move your data, object to or restrict how we use it, and withdraw consent where we rely on it. Some rights have limits (for example we may need to keep case records to defend legal claims). Email support@clearclaimip.com and we'll reply within one month.
If you're unhappy, please tell us first. You can also complain to the Information Commissioner's Office (ico.org.uk, 0303 123 1113).
Security
We protect data with encryption in transit, hashed passwords, two-step sign-in, access controls, sealed and timestamped documents, and regular reviews. No system is perfectly secure, so please use a strong password and turn on two-step sign-in.
Children
Our services are for businesses and adults. We don't knowingly collect data from anyone under 18; if we find we have, we'll delete it.
Changes
We'll post any changes here and update the date at the top. If a change matters, we'll tell you by email or in your dashboard.
